Accra, March 31, – Dr Gabriel Tanko Kwamigah-Atokple, Volta Regional Representative on the Council of State, has challenged the Economic and Organised Crime Office (EOCO) over a declaration naming him as a wanted person, describing the action as unlawful and in defiance of a High Court ruling.
Dr Kwamigah-Atokple said an Adentan High Court ruling on March 19, 2026, held that EOCO acted without mandate in its attempt to investigate him.
He said the Court also ordered the de-freezing of bank accounts that had been frozen during the investigations, ruling that the actions violated constitutional principles of fairness.
Dr Kwamigah-Atokple said the matter stemmed from a commercial dispute between JG Resources Ltd and Sesi-Edem Company Limited, a company he founded, involving a gold supply agreement covering the period June 2025 to June 2026.
According to him, the complainant admitted that about 58 per cent of the contracted gold had been supplied as of November 2025, while EOCO had also acknowledged before the Court that the contractual deadline had not expired at the time the complaint was filed.
He argued that there was therefore no legal basis to classify the outstanding quantity as fraud.
Dr Kwamigah-Atokple further stated that allegations that the transaction was unlicensed had been dismissed by the Court, noting that Sesi-Edem Company Limited held valid licences and approvals from the Precious Minerals Marketing Company, the sector minister, and the Ghana Gold Board.
He said the Court determined that the matter was a civil contractual dispute rather than a criminal case.
Dr Kwamigah-Atokple rejected claims that he had failed to cooperate with EOCO, stating that the company responded to all requests, submitted documents and appeared before investigators when required.
He said the company’s Managing Director attended EOCO in December 2025 and provided statements, describing the “wanted” notice as an attempt to damage his reputation.
He called on EOCO to respect the Court’s ruling and cease what he described as attempts to pursue through the media a matter already determined by the judiciary.
Dr Kwamigah-Atokple demanded a public apology and withdrawal of the “wanted” declaration within 12 hours, warning that he would take further legal action if the demand was not met.
