SML trial: OSP confirms two pending US proceedings against Ofori-Atta


Accra, Feb. 27, – The Office of the Special Prosecutor has confirmed that two proceedings are pending in the United States against former Finance Minister Kenneth Ofori-Atta, relating to alleged immigration violations and an extradition request.

The OSP provided the clarification after the Accra High Court sought updates on the availability of the first and second accused persons – Mr Ofori-Atta and his Chef de Cabinet, Ernest Darko Akore. The US Department of Justice, through the Attorney-General, requested guidance from OSP on whether to arrest Akore before serving him with a summons or to serve the summons first. The OSP advised the US authorities to follow the most expedient and legally appropriate procedure.

The DOJ confirmed receipt of the extradition package, and Mr Ofori-Atta has been served with the summons and charge sheet. Ghanaian proceedings, however, are set to continue.

In court, the prosecution refiled the charge sheet for the sixth accused, Col. (Rtd) Kwadwo Damoah, to reflect his official title. The overall charge sheet was amended, reducing counts from 78 to 75, with all affected accused maintaining not guilty pleas. Two additional witness statements have been filed.

The case has been adjourned to March 26, 2026, to allow for ongoing disclosures.
