Court Throws Out Democracy Hub Suit on Ayawaso East NDC Primary


Accra, March 3, 2026 – An Accra High Court has dismissed a suit filed by pressure group Democracy Hub challenging the parliamentary primary conducted by the National Democratic Congress (NDC) in the Ayawaso East Constituency.

The court ruled that the action was incompetent and procedurally flawed, holding that the case should have been initiated by an application rather than by writ.

The decision clears the way for the NDC’s candidate, Baba Jamal, who won the primary, to contest the March 3 parliamentary by-election.

Democracy Hub had sued the NDC, the Attorney-General and the Electoral Commission of Ghana (EC), alleging that the party’s primary was tainted by vote-buying and inducement.

The group sought an order to quash the EC’s recognition of Mr. Jamal as the party’s candidate and to restrain the Commission from accepting or acting on his nomination pending a fresh primary conducted in accordance with democratic principles.

It also asked the court to declare that the alleged monetisation of the process rendered the outcome unconstitutional, arguing that reliance on the results breached Article 55(5) of the 1992 Constitution and Section 9 of the Political Parties Act, 2000 (Act 574).

According to Democracy Hub, the party’s alleged failure to address reported irregularities was inconsistent with constitutional and statutory requirements.

With the suit dismissed on procedural grounds, the by-election is set to proceed as scheduled.
