Stay away from lands in Tse Addo enclave – Two families warn


Accra, Dec. 18, – Two Ga families at East Dadekotopon have cautioned against the encroachment of their lands following a Supreme Court ruling restoring their customary ownership rights.

The Ataa Tawiah Tsinaiaatse and Nuumo Ofuli Kwashie families said there were attempts to override the November 2025 apex court judgment by reallocating the disputed 2-acre parcel to a religious body that was not party to the litigation. They warned that such actions could threaten security in the Tse Addo enclave.

On November 12, 2025, the Supreme Court, presided over by Justice Pwamang JSC, set aside judgments by the High Court and Court of Appeal, describing them as “perverse” and inconsistent with the totality of evidence. The Court affirmed that the families’ 2005 customary grant, protected under Section 46(1)(f) of PNDCL 152, prevails over any later registration, particularly where the customary owners were in actual occupation.

The Court also struck down land title certificates issued to Hillsview Development Limited and its assignee, Adolph Tetteh Adjei, citing fatal procedural breaches. The families alleged that some politicians attempted to deploy security personnel to allocate the land to the religious body, citing national security, escalating tensions in the area.
